Scope of Services

Mrs. Rock is available to mediate and arbitrate throughout the State of Florida, although work is centered primarily in Miami-Dade, Broward, Palm Beach and Monroe counties. However, no traveling expenses will be charged for arbitrations or mediations conducted through the American Arbitration Association in the State of of New York

Scheduling

Mediations can be scheduled in one of the following three ways, depending upon your preference:

  • You may review the online Calendar below for presently available mediation dates, and click the “Request a Mediation” tab for the desired appointment date. Please use this option only after you have confirmed the availability of all participating parties for the requested date. Once your request is submitted, you will receive a response back within 24 hours confirming the date; OR,
  • You may contact Mrs. Rock directly at Lis@EMCMediationSolutions.com to request a mediation date or to seek any sort of special accommodation for a proposed mediation (e.g. – setting up a pre-mediation conference call, requesting a mediation lasting two consecutive days, out-of-State location, etc.); OR,
  • You may call EMC Mediation Solutions directly at (305) 720-6088, to schedule a mediation or arbitration.

Pre-Mediation Procedure

Once a mediation is scheduled, our office will send a confirming letter to all counsel. The parties are responsible for securing a location for the mediation, and Plaintiff’s counsel is thereafter responsible for filing the Notice of Mediation Conference prior to the scheduled mediation date and/or in compliance with the Court’s Pre-Trial Order. A copy of the Notice of Mediation shall be provided to EMC Mediation Solutions via email to Lis@EMCMediationSolutions.com. [NOTE: Only after receipt of the formal Notice of Mediation will the date be marked as “unavailable” in the online calendar. ] Obviously, in pre-suit matters, the Notice of Mediation need not be filed with the Court but shall still be provided to the mediator.

Submissions to the Mediator

The parties are encouraged to submit a Mediation Summary highlighting their respective positions on the dispositive issues to Lis@EMCMediationSolutions.com. While a Mediation Summary is not required, it is often helpful in alerting the mediator to important aspects of the case, and promotes greater efficiency at the mediation itself. However, the parties are also welcome to convey the same information in a pre-mediation conference call with the mediator.

Fees and Cancellation Policies

Upon request, our standard Engagement Letter with fee schedule will be provided.

Please be advised that EMC Mediation Solutions does not charge cancellation fees for mediation. [I was a litigator. I get it. Stuff happens.]
